OFFICIAL RULES 2008/09

1. NO PURCHASE NECESSARY TO ENTER OR RECEIVE A PRIZE. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
2. Ecco Domani Fashion Foundation Contest ENTRANTS AND PRIZE RECIPIENTS MUST BE LEGAL U.S. RESIDENTS OF ONE OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA AND AT LEAST 21 YEARS OLD AT TIME OF ENTRY TO BE ELIGIBLE. Employees of Ecco Domani Vineyards, DeVries Public Relations and their parent companies; Sponsor related entities; alcoholic beverage distributors and retailers; affiliates; subsidiaries; advertising and promotion fulfillment and/or judging agencies; and their immediate family members are not eligible. Contest subject to applicable federal, state and local laws and regulations. Any violation of these rules may result in disqualification. Sponsor is not responsible for errors in the administration or fulfillment of this contest, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this promotion based upon such error at its sole discretion without liability.
3. SPONSOR: Ecco Domani USA, Healdsburg, CA.
4. HERE'S HOW TO ENTER. The process begins at 12:01:00 AM Eastern Standard Time ("EST") 7/14/08, and ends at 5:00:00 PM EST on 10/3/08. To enter, go to www.eccodomani.com, complete the official application, and submit the form as directed. Entrants will be required to provide complete name, home address, telephone number, date of birth, and E-mail address. Limit one entry pre person, household, or e-mail address. Multiple or duplicate entries will be disqualified. Entries are the property of the Sponsor and will not be acknowledged or returned. Sponsor not responsible for lost, late, illegible, incomplete, misaddressed, or otherwise misdirected applications that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. ALL COMPLETE APPLICATIONS MUST BE RECEIVED BY THE CONTEST CLOSING DATE: 5:00:00 PM EST on 10/3/08.
   • WINNER SELECTION: Twenty-five (25) semi-finalists will be chosen from all entries, based on their look books and photos, the week of October 27, 2008 and will be required to submit five (5) ready-to-wear garments or accessories samples from their most recent collection by the week of November 3, 2008. Seven (7) winners (4 Womenswear, 1 Menswear, 1 Accessories, 1 Sustainable Design) will be chosen as recipients of the Ecco Domani Fashion Foundation award the week of November 24, 2008. Potential winners will be notified by mail, phone, or email; all semi-finalists who have not won will receive notification via mail. If a potential winner cannot be contacted, does not respond within ten (10) days, or prize notification is returned as undeliverable, such potential winner forfeits all rights to any prize and an alternate winner may be selected. Contest entrants agree to be bound by the terms of these Official Rules and by the decisions of the judges, which are final and binding on all matters pertaining to this contest.
5. Winners will be selected from among all eligible applications received based on the criteria outlined below.
   • Must complete the contest application form no later than October 3, 2008
   • Must be at least 21 years of age
   • Must not have been in the design business for more than 5 years
   • Must have a minimum of one retail account
   • Must be a U.S.-based designer
   • Must provide 3 references from within the fashion community
     (i.e., retailers, established designers, fashion journalists or members of industry organizations such as FGI and CFDA)
   • Must provide most recent look book OR a minimum of 10 photos/polaroids (with swatches if possible) of most recent collection; AND, if selected, may be required to submit 5 ready-to-wear garments or accessories samples from most recent collection
   • CFDA membership is not required and garment price points are not relevant
   • Must sign a contract with Contest Sponsors no later than December 1, 2008
   • Must provide a taxpayer identification number using IRS form W-9 and complete a supplier diversity form
   • Past EDFF womenswear and menswear winners may qualify to enter under the Accessories or Sustainable Design category, provided they have been in the design business no more than 5 years
6. PRIZE
   The winners will be awarded $25,000 each from the Ecco Domani Fashion Foundation to be used only for the showing of their Fall Collection at Fashion Week in New York, February 2009. As part of this agreement, winners in the Womenswear, Menswear, and Sustainable Design categories are obligated to host a fashion show during Fashion Week, February 2009 in New York. The Accessories winner, also provided $25,000, is required to present his/her collection in a presentation for members of the press and the fashion community within three months of the official winners' announcement on January 5, 2009. Recipients will have creative control over their fashion shows/ presentations and venues in New York City but must agree to the mutually agreed upon presence of Ecco Domani at these events, including signage, gift bags, sampling, attendance, etc. Winners will be paid 50% of the prize within 10 days of signing a contract, to be signed no later than December 1, 2008. Winners will be paid the remaining 50% no later than January 19, 2009. Checks will be made payable to the recipient or recipient's business. The total value of all prizes awarded for this contest is $175,000. Prize winner is solely responsible for all federal, state, and local taxes on prizes, and for any and all transportation, accommodations, meals, gratuities, personal incidentals and any other expenses necessary to take part in Fashion Week. If any of the seven winners declines a prize, winner notification(s) is returned as undeliverable, winner(s) is ineligible and an alternate winner may be selected. Winners must supply Sponsor with his/her social security number for tax purposes. In the event, for whatever reason, the 2009 Fashion Week is postponed, the winners must use the prize to show their designs at the rescheduled time. Contest entrants agree to be bound by the terms of these official rules and by the decisions of the judges, which are final and binding on all matters pertaining to this contest.
7. CLAIMING PRIZES/RELEASES. Eligibility, age, and claim by Winners are subject to verification. Winners will be notified by phone no later than the week of November 24, 2008. Sponsor is not responsible for fraudulent calls or e-mails made to entrants not by Sponsor. Potential Prize Winners must sign before a notary and return an Affidavit of Eligibility/Prize Acceptances/Liability, (where legally permissible) a Publicity Release Form within ten (10) business days of receipt, and a contract outlining details of participation in Fashion Week. Non-compliance may result in disqualification in which case the prize will be awarded to an alternate Winner(s) as selected from among all remaining applications.
8. INTERNET. If for any reson this contest is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Use of automated devices are not valid for entry. Ecco Domani/E&J Gallo is not in association with Fashion Week.
9. GENERAL. By entering this fashion contest, entrants and Winners: (1) agree to be bound by these rules; (2) agree to release Sponsor and their parent companies, Sponsor related entities, alcoholic beverage distributors and retailers; affiliates; subsidiaries; advertising and promotion fulfillment and/or judging agencies from all liability, claims, action, or proceedings relating to the contest and from injuries or damages relating to acceptance or use of the prize; and (3) Prize Winners consent to the use of their names, voices, pictures and likenesses for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law. Recipients also agree to participate in and attend events that are directly related to leveraging public relations activities surrounding the Ecco Domani Fashion Foundation.
10. NAMES OF WINNERS: Names of winners will be officially announced on January 5, 2009 in a press release.
